Terms of Service

1. Who we are, and your agreement

Petropolitan Museum is a sole proprietorship owned and operated by Eric Hollander, 971 US Highway 202N #8110, Branchburg, NJ 08876, USA ("we", "us"). By using petropolitanmuseum.com, creating a preview, or placing an order, you agree to these terms and to our Privacy Policy and Shipping and Refunds policy, which form part of them.

2. Your photos

• You confirm that you own the photos you upload or have permission to use them, and that they do not contain anyone else's copyrighted work.
• People may appear in your source photos, but we paint only your pet. We do not reproduce people.
• You grant us a licence to store and process your photos for the purpose of creating your previews and portraits, as described in the Privacy Policy. We never use your original photos for anything else without your explicit written permission.

3. How portraits are made

Portraits are generated by AI systems from your photos and reviewed for quality. Every portrait is an interpretation, so results vary and no two are identical. That is why we show you a free preview before you pay anything.

Style names on this site describe artistic movements and techniques. Petropolitan Museum is not affiliated with, sponsored by, or endorsed by any artist, artist's estate, foundation or museum.

4. Free previews

• Each visitor receives three free watermarked previews by default, and five more with every purchase. We may offer more through promotions or invitation links.
• Previews are for choosing your portrait. They are watermarked, are not for sale or resale, and remain our property until you purchase.
• We may limit previews per connection and may pause free previews when the studio is at capacity. When that happens, the site will say so.

5. Buying a portrait

• Prices are shown at checkout in US dollars. Payment is processed by Stripe.
• When you buy, you receive a personal, non-commercial licence to the final image and to any prints of it: display it, print it, share it with friends and family. You may not sell it, license it, or use it commercially.
• We retain the rights in the underlying design so that we can re-print it for you.
• We feature your finished portrait in our gallery, on social media or in other marketing only if you give us permission by ticking the box at checkout. The box starts unticked. You can withdraw your permission at any time by emailing us; see section 5 of the Privacy Policy.

6. Orders, shipping and refunds

Physical products are made to order. Production and delivery times, what happens if something arrives damaged, and our refund rules are set out in the Shipping and Refunds policy, which forms part of these terms.

7. Acceptable use

Do not upload unlawful, abusive or infringing content, attempt to bypass the free-preview limits, or use automated tools to access the site. We may decline, cancel or refund any order and suspend access to the service if these terms are broken.

8. Emails

We send order emails (confirmation, shipping notices) to everyone who orders, because they are part of the service. We send news and offers only if you opted in, and every such email has an unsubscribe link.

9. Disclaimers and limitation of liability

The service is provided "as is". To the fullest extent permitted by law, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us for the order concerned. Nothing in these terms limits liability that cannot be limited by law.

10. Governing law

These terms are governed by the laws of the State of New Jersey, USA. Any dispute will be heard in the state or federal courts located in New Jersey, and you consent to their jurisdiction.

11. Changes to these terms

If we change these terms we will update the date at the top of this page. The terms in force when you place an order are the ones that apply to it.
